1. Applicability
These terms and conditions ("Terms") apply to all agreements and to the use of the BRIX Calc platform, including its applications, websites, calculation modules and related services (together the "Service"), provided by Hive Concepts B.V., trading as BRIX Calc, registered with the Dutch Chamber of Commerce under number 95842934 ("BRIX Calc", "we", "us"). By using the Service, you ("User", "you") agree to these Terms.
2. Use of the Service
The Service provides calculation models, scenarios and insights to analyse real estate investments and transactions. The outputs are indicative and depend on the data you provide.
BRIX Calc does not guarantee that calculations are error-free, complete, or up to date. Technical errors, software bugs, rounding differences or incorrect input may lead to incorrect or deviating results.
The Service does not constitute financial, tax or legal advice. You remain solely responsible for verifying results and for any (investment) decisions you make.
You must provide accurate and up-to-date information and may only use the Service for legitimate purposes and in compliance with applicable laws and regulations.
3. Financial Disclaimer
The calculation tools and results on this platform are intended solely for informational and educational purposes. They do not constitute financial, tax, or legal advice.
We provide no guarantees regarding the accuracy, completeness, or timeliness of the calculations. Technical errors, software bugs, rounding differences, or incorrect input may lead to incorrect or deviating results.
You are solely responsible for verifying results and making investment decisions. Always consult a certified financial advisor, tax consultant, or legal expert before making financial decisions based on these tools.
BRIX Calc is not liable for any damages arising from the use of these tools or decisions you make based on the presented results.
4. Subscriptions and Payments
Current subscription plans and pricing are listed on our website.
Subscriptions are billed in advance and automatically renewed unless terminated in time.
Payments are processed through the payment methods made available by us. If a payment fails, we reserve the right to suspend your access to the Service.
We may adjust pricing and subscription models. You will be notified in advance. If you do not agree, you may terminate your subscription.
5. Accounts and Security
To use the Service you must create an account. You are responsible for keeping your login details confidential and for all activities under your account.
You must notify us immediately if your account details are lost, stolen or misused.
We may refuse, suspend or terminate accounts in case of misuse, fraud, non-payment or violation of these Terms.
6. Intellectual Property
All rights to the software, calculation models, designs, content and documentation of the Service remain with BRIX Calc or its licensors.
You may not copy, modify, distribute, publish, resell or otherwise commercially exploit the Service without prior written consent.
7. Restrictions on Use
You may not use the Service in any way that is unlawful or infringes the rights of third parties. This includes, without limitation:
- distributing unlawful, misleading or discriminatory content;
- disrupting the Service (e.g. through hacks, scraping, malware or denial-of-service attacks);
- reselling, sublicensing or otherwise making the Service available to third parties without permission.
BRIX Calc may restrict or terminate your access in case of violations.
8. Liability
BRIX Calc strives to provide the Service carefully and continuously but does not guarantee uninterrupted or error-free operation.
We are not liable for damages resulting from:
- technical errors, malfunctions or inaccuracies in calculations or reports;
- decisions you make based on results generated by the Service;
- indirect or consequential damages, including lost profits, loss of data or investment losses.
Our total liability is in any case limited to the amount you have paid to us for the Service in the twelve (12) months preceding the event causing the damage.
This limitation does not apply in cases of intent or gross negligence by the management of BRIX Calc.
9. Privacy and Data
We process personal data in accordance with applicable privacy laws and our Privacy Policy.
You remain responsible for the accuracy of the data you input.
You may not process personal data of other users other than in the context of your use of the Service.
10. Termination
You may terminate your account and subscription at any time via your account settings.
We may suspend or terminate accounts in case of misuse, non-payment or violation of these Terms.
Upon termination, your access to the Service will cease and we may delete your data, unless retention is required by law.
11. Force Majeure
We are not obliged to perform any obligation if this is reasonably impossible due to circumstances beyond our control, including but not limited to failures in internet or telecom networks, pandemics, government measures, labour disputes or other force majeure events.
12. Amendments
We may amend these Terms from time to time. Significant changes will be notified to you in advance. If you do not agree, you may terminate your account.
13. Governing Law and Jurisdiction
These Terms are governed by Dutch law. Any disputes will be submitted to the competent court in Utrecht, the Netherlands, unless mandatory law provides otherwise.
